Bakersfield: Two Men Arrested on Suspicion of Transportation of Marijuana for Sale (CA Health and Safety Code 11360)

News outlets report that over 3 tons of marijuana, 252 bales was discovered during a routine traffic stop near Bakersfield.  Allegedly, local law enforcement officials pulled over a rented U-Haul truck after its driver, 22-year-old (name withheld in order to protect the privacy of the accused) ran a red light.  Officers thought they smelled the drug coming from the truck and brought in a K-9 unit to sniff out the scene.  A passenger in the truck,(24) (name withheld in order to protect the privacy of the accused) was also present and the 2 were arrested on suspicion of transportation of marijuana for sale and on charges of conspiracy.

In California, it’s rare for anyone caught buying small amount of marijuana to be saddled with jail time.  Usually, a fine is all the punishment given.  However, when it comes to selling pot, the law is quite different.  California Health and Safety Code 11360 covers this particular crime and makes it a felony.  Even without proof that you plan to sell marijuana, police officers can make a case that you intended to because of the amount they find.
