Founder of Zeitgeist Artist Management Convicted of Assault (CA Penal Code 240)

41-year-old manager (name withheld for privacy) for popular bands such as Death Cab for Cutie, She & Him, and Bob Mould, head of Zeitgeist Artist Management, was convicted today of misdemeanor assault charges resulting from an altercation with his girlfriend. The San Francisco man was charged this past September after having asked his then girlfriend to move out of their shared home.  The two fought verbally and witnesses claim that he only pushed the woman down and delivered a swift kick to her side after she pushed him. The former girlfriend herself confirms that she acted first and attempted to aggravate the situation.

(CA Penal Code 240) covers ‘assault’ and it is important to know that actual bodily injury need not result in order for you to be charged with this particular crime.  In fact, prosecutors need only prove that harm was intended in order to get a conviction. Of course, this often leads to the wrongful arrest and false accusation of persons who did not actually intend to engage in assault.  While someone convicted of misdemeanor assault faces probation, community service, enrollment in and completion of a state-sanctioned program for batters, up to 6 months in county jail, and a maximum $1,000 fine, he has been sentenced to 52 weeks of counseling on domestic violence and 3 years of probation.
