Why Hiring a San Jose-Based Defense Team Matters

There’s no denying that criminal charges are stressful, and choosing the right criminal defense lawyer can make all the difference in the outcome of your case.

A criminal case is not just “California law.” It is how local agencies investigate, how the District Attorney charges, how judges schedule hearings, and what evidence is typically relied on in Santa Clara County courtrooms.

A San Jose-focused criminal defense team can help you create a strategy that’s best for your situation because they’ve dealt with similar issues in the past and they will know how to approach your case.

Understanding Where Your Case Will Actually Be Heard

Most San Jose criminal cases run through the Santa Clara County Superior Court system, often at the Hall of Justice on West Hedding Street. Depending on the type of matter, you may also see related proceedings connected to the Family Justice Center Courthouse.

We build your defense around the court’s pace, the type of calendar your case lands on, and what typically happens at each stage.

Recognizing Local Investigation Patterns

San Jose cases often start with an investigation by San Jose Police Department, the Santa Clara County Sheriff’s Office, or specialized units, then move quickly into charging decisions.

We look for issues that show up repeatedly in local cases, including:

  1. How statements were collected during interviews or in-custody questioning
  2. Whether searches were supported by valid warrants or consent
  3. Whether reports match body-worn camera footage or dispatch records
  4. Whether witness accounts changed after follow-up interviews
  5. Whether the prosecution can prove every element beyond a reasonable doubt

Building a Defense That Fits the Reality of Your Life in San Jose

People here worry about more than the courtroom. A conviction can affect professional licenses, tech employment background checks, UCSC or SJSU student discipline, immigration status, and housing stability.

We address these consequences early, not after a plea is already on the table.

Criminal Charges We Defend in San Jose

Summit Defense defends a wide range of criminal allegations in San Jose and Santa Clara County. The specific strategy depends on the facts, your history, the evidence, and what the prosecution can actually prove.

DUI and Drug-Related Offenses

This includes alcohol DUIs, drug DUIs, prescription medication allegations, simple possession, possession for sale allegations, and other controlled substance offenses. Our DUI defense attorneys focus on the stop, the detention, the testing, the chain of custody, and whether officers followed required procedures.

Domestic Violence and Restraining Order-Related Allegations

Domestic violence cases move fast and often involve emergency protective orders, no-contact orders, and immediate housing or parenting consequences. We evaluate the allegation itself, the injury claim, credibility issues, and any evidence that contradicts the report.

If your spouse was just arrested, start with our guide: What to Do If Your Husband or Wife Is Arrested for Domestic Violence in San Jose.

Assault, Battery, and Violent Crime Allegations

From simple assault to felony battery claims or allegations involving weapons, we evaluate self-defense, mutual combat issues, intent, injury evidence, and witness reliability.

Theft and Property Crimes

This includes shoplifting, petty theft, grand theft, burglary, robbery allegations, identity theft, and fraud. We focus on intent, identification, surveillance, inventory records, and whether the alleged loss is being exaggerated.

Sex Crime Allegations

Sexual misconduct allegations demand discretion, speed, and serious litigation planning. We scrutinize statements, timelines, digital evidence, forensic issues, and any motive to fabricate or misinterpret events.

White Collar and Professional Exposure Cases

Embezzlement, fraud, and related allegations often involve documents, internal workplace investigations, and pressure to “explain” yourself. We help you avoid costly mistakes and develop a plan that addresses both the criminal case and career impact.

If you do not know exactly what you are being accused of, or you have not been formally charged yet, that is still the right time to call. Early representation can prevent charges from escalating.

What Happens After an Arrest in San Jose

Most people call because they do not know what comes next. The process is stressful, and the steps can feel impersonal. Here is the typical progression in San Jose cases.

Booking and Release

After arrest, booking usually includes fingerprinting, photographs, and recording the allegation. Release may happen by:

  1. Bail
  2. Release on your own recognizance
  3. Jail release after a hold clears
  4. Court-ordered conditions

If you are being held, we can evaluate ways to argue for reasonable release conditions.

Arraignment at the Hall of Justice

Arraignment is often where you first see the formal charging document. The court advises you of the charges and asks for a plea.

This is not the moment to “tell your story.” It is the moment to protect your rights, get discovery, and start building leverage. Many cases are won by what happens immediately after arraignment, not by last minute arguments later.

Protective Orders and Release Conditions

Domestic violence and related allegations may trigger temporary protective orders. Other cases may come with conditions like travel limits, check-ins, or stay-away orders. We help you understand what is required and how to request modifications when appropriate.

Discovery, Motions, and Negotiation

After arraignment, the defense obtains police reports, recordings, and other evidence. This is where your case becomes real. We identify what is missing, what is inaccurate, and what can be challenged.

How We Build a San Jose Defense Strategy

We do not use a template defense. Your strategy should fit the facts, the evidence, and your goals.

Our process typically includes many steps, many before you appear in a courtroom.

Early Case Review and Risk Assessment

We start by identifying:

  1. What the prosecution must prove
  2. What evidence exists and what is absent
  3. What defenses apply legally and factually
  4. What outcomes are realistic and what steps help you get there

Investigation Beyond the Police Report

Police reports are not the full story. We pursue witness interviews, video evidence, phone records where relevant, expert review, and documentation that supports your timeline.

Litigation Planning From Day One

Even if a case resolves without trial, the path to a strong outcome often runs through readiness. We prepare as if litigation may be necessary so the prosecution knows you are not negotiating from fear.

Negotiation With a Purpose

We negotiate from a position of preparation. That means highlighting weaknesses, pushing back on inflated charges, and seeking outcomes that minimize collateral damage.

Mitigation That Actually Helps

Sometimes the best strategy includes demonstrating stability and accountability. We guide clients on what helps and what hurts, especially when a judge or prosecutor will weigh risk, rehabilitation, and community ties.

Meet Your San Jose Criminal Defense Team

When your case is in Santa Clara County, you work directly with the attorneys who handle our San Jose cases. Rabin Nabizadeh, Ross Pytlik, and Mario Andrews defend clients at the Hall of Justice in San Jose, the Palo Alto Courthouse, and the South County Courthouse in Morgan Hill. Between them, they bring the perspective of a former prosecutor, a former police officer, and a defense attorney who builds every strategy around long-term consequences.

Rabin Nabizadeh, Founding Partner

Rabin has practiced law since 2004, representing clients in California state and federal courts. He looks at every case through the lens of long-term consequences, including how a conviction can affect immigration status, a critical issue for non-citizen clients. He speaks Hebrew and Farsi, and he is a graduate of UCLA and of UC Hastings College of the Law, where he was named Best Oral Advocate in moot court. Recent result: a felony domestic violence case that included allegations of spousal rape was dismissed after the preliminary hearing.

Ross Pytlik

Ross is a former prosecutor with years of experience conducting trials and testimonial hearings, and he now uses that insight to defend clients. Super Lawyers has selected him four times as a Northern California Rising Star. He earned his B.A. in Political Economy from UC Berkeley and his J.D. from Hastings College of the Law, and he taught high school history before practicing law.

Mario Andrews

Mario is a former police officer, investigator, and prosecutor, so he knows how police build cases and how prosecutors evaluate them. That matters most early: when a case is still under investigation, he can anticipate the next steps and advise you before charges are filed. He served four years on Oakland’s Citizens’ Police Review Board, including a year as chair.

Key Defense Approaches That Often Matter in Santa Clara County Cases

Every case is unique, but certain issues show up repeatedly in San Jose prosecutions.

Challenging Stops, Searches, and Seizures

Many cases begin with a traffic stop, a patrol contact, or a search of a person, vehicle, or home. If the stop or search was unlawful, we can pursue motions to suppress evidence. When key evidence is suppressed, cases often weaken significantly.

Statement and Miranda Issues

People are often questioned at the scene, during booking, or later by phone. Sometimes officers imply you can “clear it up” by talking. We evaluate whether your rights were respected and whether statements should be excluded or contextualized.

Identification and Witness Reliability

Misidentification is a real issue in theft and assault allegations. We look at:

  1. Lighting and distance
  2. Stress and timing
  3. Prior familiarity between witness and accused
  4. Suggestive identification procedures
  5. Conflicting descriptions

Self-Defense and Defense of Others

In many assault cases, the key question is who was the aggressor and what was reasonable under the circumstances. We gather evidence that supports your perspective, including injuries, witness accounts, and timeline reconstruction.

Timeline, Digital Evidence, and Alibi Support

Receipts, location data, surveillance, and messages can matter. If your case turns on where you were and when, we organize the timeline and find corroboration early.

Plea Bargains, Diversion, and Alternative Resolutions

Not every case should go to trial. Not every plea offer should be accepted. The right resolution depends on the facts, the evidence strength, and the consequences you are trying to avoid.

We evaluate plea options so that you understand what you’ll gain from taking a plea or if we feel you should fight in court.

What Are You Actually Pleading To

The charge label matters, but so do enhancements, probation terms, and admissions that can affect future cases.

What the Real Penalties Look Like

“Standard” penalties can change based on your history, the allegation details, and how the court views risk. We explain what is likely, what is possible, and what is worth fighting.

How the Outcome Affects Your Future

Many clients care most about employment, licensing, immigration consequences, or keeping a clean record. We build the strategy around those priorities.

When available, we also explore alternatives like diversion programs or resolutions that reduce long-term damage.

Criminal Defense for Immigrants in Santa Clara County

Santa Clara County is one of the most international communities in the country. According to the U.S. Census Bureau, about 41.5% of county residents were born outside the United States. That includes H-1B and other work-visa holders, green card holders, asylum seekers, and DACA recipients. For them, a criminal case is never just a criminal case. A plea that looks minor in state court can threaten a visa renewal, a green card, citizenship, an asylum claim, or DACA, and in some cases it can lead to removal proceedings.

What’s at Stake

H-1B and other work visas. An arrest or conviction can come up at visa renewal, consular processing, or reentry, and can put employment-based status at risk.

Green card holders. Certain convictions, including aggravated felonies, controlled substance offenses, crimes involving moral turpitude, and domestic violence offenses, can make a permanent resident deportable or derail naturalization.

Asylum seekers. A conviction for a “particularly serious crime,” which includes any aggravated felony, can bar asylum.

DACA recipients. A felony, a “significant misdemeanor” such as DUI or domestic violence, or three or more other misdemeanors can end DACA eligibility.

Solutions Beyond Dismissal

Dismissal is always the first goal. When it isn’t realistic, the right resolution can still protect your status. California law requires defense counsel to give accurate, affirmative advice about a plea’s immigration consequences. It also requires prosecutors to consider avoiding adverse immigration consequences as one factor in plea negotiations (Penal Code § 1016.3). Depending on the case, options include:

  • Immigration-safe pleas: a plea to an alternative offense that doesn’t carry the same immigration consequences as the original charge.
  • Careful sentencing: California misdemeanors carry a maximum of 364 days (Penal Code § 18.5), and keeping a sentence under one year can make a critical difference under immigration law.
  • A protective record of conviction: controlling what facts appear in the plea and court record so a conviction isn’t later treated as a deportable offense.
  • Pretrial diversion: programs that end in dismissal without a guilty plea, which can avoid a “conviction” for immigration purposes.
  • Fixing past convictions: motions to vacate convictions entered without proper immigration advice (Penal Code § 1473.7).

Immigration Counsel on Your Defense Team

If you are not a U.S. citizen, your Summit Defense team includes Scott Mossman, a criminal immigration attorney who advises our defense attorneys and clients on the immigration consequences of each possible resolution. Scott is an active member of the American Immigration Lawyers Association, where he serves as co-liaison to Immigration and Customs Enforcement for Northern California, and he previously served three years as AILA’s co-liaison to U.S. Customs and Border Protection. He teaches seminars for other attorneys on creating immigration-safe records of conviction and on dispositions that avoid the immigration definition of a conviction. He graduated in the top 5% of his class at UC Davis School of Law. Learn more about our criminal immigration defense.

What You Should Do Right Now if Police Contacted You

A lot of San Jose cases start before an arrest. You may have been contacted by an officer, received a call from a detective, or learned that a report was made.

You need to protect yourself and your loved ones, especially if you feel you are innocent or if you’re worried about getting into more trouble.

Do Not Explain Yourself to “Clear Things Up”

Even truthful statements can be misinterpreted, selectively recorded, or used to fill gaps in a weak case. You can be polite while still refusing questions.

Do Not Consent to Searches

If officers ask to search your phone, vehicle, or home, you can decline. Consent removes important legal protections.

Document What You Remember

Write down the timeline, names, locations, and anything you noticed that seems small. Details fade quickly and can become important later.

Frequently Asked Questions About San Jose Criminal Defense

Do I have to go to court for a San Jose criminal case?

Most cases require at least one appearance. Depending on the charge and the court, an attorney may be able to appear on your behalf for certain hearings, but some appearances require you to be present. We tell you what is required for your specific case.

What should I do immediately after an arrest in San Jose?

Stay calm, remain silent, and ask for an attorney. Do not discuss the facts of the case with police, other inmates, or over recorded jail calls. Contact a defense lawyer as soon as possible so the defense can start early.

What is the difference between a misdemeanor and a felony in California?

Misdemeanors generally carry lower maximum penalties than felonies, but they can still result in jail time, probation, fines, and a record. Felonies carry higher exposure, can include prison time, and may create additional long-term consequences. Some offenses can be charged either way depending on the facts.

Can my charges be dismissed?

Dismissal is possible in cases involving weak evidence, witness problems, legal violations, or failure to prove all elements of the charge. No attorney can promise a dismissal, but early investigation and motion practice can create opportunities to challenge the case.

Should I talk to the police if I am innocent?

In most situations, no. Innocent people can still be charged based on misunderstandings, incomplete facts, or misinterpretation of statements. You can assert your right to remain silent and request an attorney.

How long do criminal cases take in Santa Clara County?

Some matters resolve quickly, while others take months or longer depending on the complexity, evidence volume, court scheduling, and whether the case goes toward trial. We can give you a clearer estimate after reviewing your charge and court assignment.

How much does it cost to hire a criminal defense attorney in San Jose?

Cost depends on the charge, complexity, and whether the case is likely to involve motion practice or trial preparation. Summit Defense offers free consultations and will explain fees and payment options after understanding your situation.

What if I cannot afford a private attorney?

If you qualify, the court can appoint a public defender. Public defenders are often skilled, but they may be managing very heavy caseloads. If you are unsure what is best for you, we can discuss options during a consultation.

Will an arrest show up on a background check?

Depending on the type of background check and the status of the case, an arrest and court record may appear. Outcomes like dismissal or later record relief may change what shows up, but it depends on the circumstances.

Can I travel while my case is pending?

It depends on your release conditions. Some cases include travel restrictions or require permission. Violating conditions can create new problems, so it is important to confirm before making plans.

What happens if I miss a court date in San Jose?

Missing court can result in a bench warrant and additional penalties. If you missed a date or think you might miss one, contact an attorney immediately so steps can be taken to address it quickly.

What if this is my first offense?

First-time defendants may be eligible for more favorable outcomes depending on the charge and facts, including reduced charges, diversion, or alternative sentencing. We focus on protecting your record and minimizing long-term consequences.

Bay Area Sentencing Disparities

Santa Clara County has been led by District Attorney Jeffrey Rosen since 2011 — one of the longest, most stable tenures of any DA’s office in the Bay Area, and one that’s built a national reputation around criminal justice reform. That stability shapes what clients can expect here more than almost anything else: charging patterns, plea posture, and diversion eligibility in Santa Clara County reflect over a decade of consistent office policy, not the shifting politics of a county that, on paper, looks similar to several of its neighbors. Understanding a specific DA’s office — not a generic idea of “California sentencing” — is central to building an effective defense here.
