Homicides expose a defendant to a significant amount of state prison sentence and, in some instances, the possibility of life in prison without the possibility of parole.

Homicide – DEFINITIONS, ANALYSIS 

Homicide is the unlawful killing of one human being by another. Homicide includes both murder and manslaughter.

Murder (Penal Code section 187) There are two types of Murder charges: First Degree murder is the unlawful and unjustified killing of another human being with malice aforethought and premeditation. This premeditation requirement is what sets murder apart from second degree murder and other Homicide cases.  Simply put first degree murder means that there was an intent and some time to deliberate in order to bring about another person’s death.  Second Degree murder requires malice, or intent to kill, but not premeditation.

 

Manslaughter Penal code section 192 –  There are two types of manslaughter charges; Voluntary manslaughter and Involuntary manslaughter.

Voluntary manslaughter refers is the killing of another without prior intent or deliberation but usually done in the heat of passion.  It is crucial to note that the law expects the heat of passion to cool very quickly.

Involuntary manslaughter refers to an unintentional, but nevertheless, criminal killing.  A prosecutor would usually have to prove gross negligence to prevail on this charge.

Vehicular Manslaughter is the killing of another while driving a motor vehicle.  The cause of death could be a traffic violation or a known defect in the vehicle.
